End User License Agreement

IMPORTANT: PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS SOFTWARE.

This End User License Agreement ("EULA") is a legal agreement between you and MOTHblank ("Licensor") for the "Phosphor Archive" software (the "Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA.

1. License Grant

MOTHblank ("Licensor") grants you a non-exclusive, non-transferable, limited license to use the "Phosphor Archive" software for personal, non-commercial use only, subject to the terms of this EULA.

2. Restrictions

You shall not:

  1. Copy, redistribute, sublicense, or rent the Software.
  2. Decompile, reverse engineer, or disassemble the Software.
  3. Modify or create derivative works based on the Software.
  4. Use the Software for any commercial purpose without prior written consent from the Licensor.

3. Ownership

The Software is licensed, not sold. Licensor retains all ownership, intellectual property rights, and copyright to the Software and its assets (code, graphics, audio, and design).

4. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice from the Licensor if you fail to comply with any term(s) of this EULA.

5. No Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

6. Limitation of Liability

IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SOFTWARE.
