End User License Agreement

IMPORTANT: PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS SOFTWARE.

This End User License Agreement ("EULA") is a legal agreement between you and MOTHblank ("Licensor") for Phosphor Archive (the "Software"). By installing or using the Software, you agree to this EULA.

1. License Grant

MOTHblank grants you a limited, non-exclusive, non-transferable, revocable license to install and use Phosphor Archive for personal, non-commercial entertainment, subject to this EULA and applicable platform terms.

2. Restrictions

You may not:

redistribute, sublicense, rent, sell, or commercially exploit the Software or its original assets without prior written permission;
copy, modify, create derivative works from, decompile, reverse engineer, or disassemble the Software except where applicable law expressly permits it;
use cheats, exploits, automation, tampering, or other methods intended to manipulate progression, leaderboards, achievements, advertising rewards, or cloud-save behavior; or
use the Software in violation of applicable law or the rights of others.

3. Ownership

The Software is licensed, not sold. MOTHblank retains all rights, title, and interest in its original code, game systems, graphics, audio, interface, designs, and documentation, except for third-party materials used under their respective licenses.

4. Advertising and Gameplay Rewards

The Android version may display banner, interstitial, and rewarded advertising. Gameplay benefits obtained from rewarded advertising are licensed for use inside the game, have no cash value, and are not redeemable for money.

5. Google Play Games and Cloud Features

Leaderboards, achievements, authentication, and cloud-save features rely on Google Play Games Services. Their availability can depend on your Google account, device, network connection, and Google's services. These features may change or become unavailable because of maintenance, platform changes, security needs, or service-provider changes.

6. Updates and Changes

The Software may receive updates that add, remove, rebalance, or modify content, progression, compatibility, services, and technical requirements.

7. Termination

This license remains effective until terminated. Your rights may terminate if you materially violate this EULA. Upon termination, you must stop using the Software.

8. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. MOTHBLANK DOES NOT GUARANTEE UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR COMPATIBILITY WITH EVERY DEVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOTHBLANK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE.

10. Privacy

Your use of Phosphor Archive is also subject to the Phosphor Archive Privacy Policy.
