End User License Agreement

IMPORTANT: PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS SOFTWARE.

This End User License Agreement ("EULA") is a legal agreement between you and MOTHblank ("Licensor") for Hestia Tuner (the "Software"). By installing or using the Software, you agree to this EULA.

1. License Grant

MOTHblank grants you a limited, non-exclusive, non-transferable, revocable license to install and use Hestia Tuner for personal, non-commercial use, subject to this EULA and applicable platform terms.

2. Restrictions

You may not redistribute, sublicense, rent, sell, or commercially exploit the Software or its original assets without prior written permission. You may not copy, modify, create derivative works from, decompile, reverse engineer, or disassemble the Software except where applicable law expressly permits it.

3. Ownership

The Software is licensed, not sold. MOTHblank retains all rights, title, and interest in its original code, interface, designs, audio assets, documentation, and other original materials, except for third-party materials used under their respective licenses.

4. Microphone, Background Playback, and Advertising

Hestia Tuner requires microphone permission for pitch detection and can use an Android foreground media-playback service for the metronome. The Android version may also display third-party banner advertising through Google AdMob. Your use of these platform and third-party features is also subject to applicable Android and Google terms.

5. Measurement Accuracy

Pitch and tuning readings are provided as a practice and instrument-tuning aid. Results can vary because of microphone hardware, environmental noise, instrument characteristics, operating-system behavior, and device audio processing. The Software is not guaranteed to provide laboratory-grade or professionally calibrated measurement accuracy.

6. Updates and Changes

The Software may receive updates that add, remove, or modify features, supported devices, audio behavior, advertising integration, compatibility, and technical requirements.

7. Termination

This license remains effective until terminated. Your rights may terminate if you materially violate this EULA. Upon termination, you must stop using the Software.

8. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. MOTHBLANK DOES NOT GUARANTEE UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR COMPATIBILITY WITH EVERY DEVICE OR AUDIO INPUT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOTHBLANK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE.

10. Privacy

Your use of Hestia Tuner is also subject to the Hestia Tuner Privacy Policy.
